# San Andreas Bar Association

The **San Andreas Bar Association** oversees the professional licensing and standing of attorneys authorized to practice law within the State of San Andreas.

An individual must be properly admitted to the Bar before representing another person as legal counsel before the San Andreas Judiciary unless a specific exception is authorized by law.

## Responsibilities of the Bar

The San Andreas Bar Association may:

* Review applications for admission;
* Establish minimum competency requirements;
* Administer Bar examinations or evaluations;
* Maintain attorney licensing records;
* Assign Bar identification numbers;
* Determine attorney status;
* Investigate professional misconduct;
* Review complaints;
* Impose or recommend professional discipline;
* Suspend or revoke authorization to practice when permitted;
* Establish continuing professional requirements; and
* Maintain a public roster of attorneys in good standing.

# Admission to the Bar

An applicant seeking admission should demonstrate sufficient legal knowledge, judgment, and professionalism to practice law.

Admission may include:

* Professional responsibility; and

# Attorney Status

| **Inactive**     | Member of the Bar but not currently authorized to practice          |
| **Pending**      | Admission or status review has not been completed                   |

| **Revoked**      | Authorization to practice has been withdrawn                        |

Only an **Active** attorney, or a Probationary attorney when their conditions permit it, should represent another person before the Judiciary.

# Bar Identification Number

Each admitted attorney may be issued a unique Bar identification number.

Attorneys should include their Bar number where reasonably required on:

* Court filings;
* Formal motions;
* Legal notices;
* Attorney rosters;
* Bar records; and
* Other official legal documents.

A Bar number belongs to the individual attorney and shall not be transferred to another person.

# Professional Duties

Members of the Bar are expected to:

* Provide competent representation;
* Communicate reasonably with clients;
* Protect client confidentiality;
* Avoid material conflicts of interest;
* Act honestly before the court;
* Follow lawful judicial orders;
* Preserve evidence;
* Comply with discovery requirements;
* Avoid frivolous litigation intended solely to harass or delay;
* Treat participants professionally; and
* Protect the integrity of the legal profession.

# Duty to the Client

An attorney shall act in the lawful interests of the client.

The attorney should:

* Explain material legal options;
* Communicate significant developments;
* Maintain confidentiality;
* Avoid abandonment;
* Prepare reasonably for proceedings;
* Advocate zealously within the law; and
* Respect decisions legally reserved to the client.

The client ordinarily decides whether to:

* Plead Guilty or Not Guilty;
* Accept or reject a plea agreement;
* Testify;
* Waive significant rights; or
* End representation.

The attorney provides advice concerning those decisions.

# Attorney-Client Confidentiality

Confidential communications made for the purpose of seeking or providing legal representation should remain protected to the extent provided by law.

An attorney shall not intentionally disclose protected client information without authorization unless disclosure is legally required or an applicable exception exists.

# Duty to the Court

An attorney is also an officer of the court.

An attorney shall not knowingly:

* Make a materially false statement to the Judiciary;
* Present fabricated evidence;
* Encourage false testimony;
* Conceal evidence in violation of law;
* Violate a lawful judicial order;
* Misrepresent controlling legal authority;
* Improperly influence a judge, witness, or court employee;
* Abuse court procedures solely to delay proceedings; or
* Engage in conduct that substantially obstructs justice.

Advocacy does not require an attorney to agree with the court or opposing counsel.

Professional disagreement is permitted.

# Competence

An attorney should possess the legal knowledge and preparation reasonably necessary for the matter they accept.

Competence may include:

* Reviewing applicable law;
* Understanding the charges or claims;
* Reviewing discovery;
* Preparing witnesses;
* Identifying legal issues;
* Meeting filing requirements;
* Understanding courtroom procedure; and
* Seeking assistance when a matter exceeds the attorney's experience.

# Conflicts of Interest

An attorney should not accept or continue representation when a substantial conflict materially threatens the attorney's loyalty or independent judgment.

Potential conflicts include:

* Representing opposing parties in the same matter;
* Representing multiple defendants with materially conflicting interests;
* Personal involvement in the underlying event;
* A significant financial interest in the outcome;
* Prior representation creating conflicting duties; or
* Another circumstance that prevents loyal representation.

When possible, a conflict should be disclosed and resolved before substantive representation continues.

# Communications With Represented Persons

An attorney should not intentionally bypass another person's known counsel concerning the subject of active representation when professional rules prohibit such communication.

Ordinary scheduling, emergency, or administrative communications may be permitted when appropriate.

# Legal Fees

Private attorneys may charge reasonable fees for legal services.

Fee arrangements should be communicated clearly.

An attorney shall not:

* Guarantee a judicial outcome in exchange for payment;
* Misrepresent government fees as personal attorney fees;
* Use threats or fraud to collect payment; or
* Imply that payment can purchase improper influence over a judge or prosecutor.

# Withdrawal From Representation

An attorney should not abandon an active client without reasonable cause.

When a matter is pending before the court, withdrawal may require judicial approval.

Possible grounds include:

* Client request;
* Replacement counsel;
* Conflict of interest;
* Serious breakdown of the attorney-client relationship;
* Nonpayment under an otherwise lawful fee agreement;
* Attorney unavailability;
* Client demand that counsel engage in unlawful conduct; or
* Another substantial reason.

The attorney should take reasonable steps to avoid unnecessary prejudice to the client.

# Practicing Without an Active License

A person without authorization to practice law shall not knowingly represent themselves to others as an active attorney.

An unlicensed person may still:

* Represent themselves when permitted;
* Discuss general legal information;
* Assist with non-legal administrative matters; or
* Perform another activity not reserved to licensed counsel.

# Bar Complaints

A person may submit a complaint alleging attorney misconduct.

A useful complaint should identify:

* Attorney;
* Bar number, if known;
* Case or matter;
* Alleged conduct;
* Relevant date or period;
* Supporting evidence; and
* Requested review.

  An unfavorable result, disagreement over strategy, or personality conflict does not by itself establish attorney misconduct.

# Complaint Review

A professional complaint may proceed through:

# Professional Discipline

Possible disciplinary outcomes may include:

* No action;
* Advisory guidance;
* Formal warning;
* Required remedial education;
* Probationary status;
* Practice restrictions;
* Temporary suspension;
* Revocation of Bar membership; or
* Referral for criminal investigation when independent evidence of a crime exists.

Discipline should be proportionate to the seriousness, frequency, intent, harm, and surrounding circumstances.

# Emergency Suspension

When credible evidence establishes an immediate and substantial threat to clients or the integrity of the judicial system, an authorized Bar or judicial authority may temporarily suspend an attorney pending formal review.

Emergency suspension should not substitute for a final disciplinary determination.

The attorney should receive a reasonable opportunity for review.

# Reinstatement

A suspended, inactive, or formerly revoked attorney may request reinstatement when permitted.

The reviewing authority may consider:

* Reason for loss of active status;
* Compliance with prior disciplinary conditions;
* Time elapsed;
* Subsequent conduct;
* Current legal competency;
* Risk to clients or the judicial system; and
* Any remedial steps completed.

Reinstatement is not automatic.

# Public Bar Roster

The Bar Association may maintain a public roster containing:

* Attorney name;
* Bar number;
* License status;
* Organization or office;
* Admission date;
* Practice information when provided; and
* Public disciplinary status when appropriate.

Confidential investigative information should not be publicly disclosed merely because a complaint was filed.

Prosecutors and public defenders must remain members of the Bar when their positions require the practice of law.

Government employment does not exempt an attorney from professional standards.
